Hexmodal Inc. (“Hexmodal,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect personal information collected through hexmodal.com and related marketing pages (the “Website”), and through email, phone, and other channels through which you interact with our marketing, sales, and support teams.

This policy applies to information collected from Website visitors, prospective customers, support inquiries, and recipients of our marketing communications. It does not apply to information we process on behalf of customers under a separate written agreement governing use of the Hexmodal Platform; that information is handled in accordance with the applicable customer agreement.

1. Information we collect

Information you provide

We collect personal information that you provide directly, such as when you complete a contact form, request a demo or quote, subscribe to communications, attend an event, or contact support. This may include:

  • Name and job title;
  • Business email address and phone number;
  • Company name, address, and industry;
  • The content of messages, support requests, or other communications you send us;
  • Information about your interest in specific Hexmodal products or services.

Information collected automatically

When you visit the Website, we and our service providers automatically collect certain information about your device and use of the Website, such as:

  • IP address and general location (typically city or region);
  • Browser type, operating system, and device identifiers;
  • Pages viewed, time spent, referring URLs, and links clicked;
  • Date and time of access and other log information.

Information from third parties

We may receive information about you from third parties such as business contact databases, event organizers, partners, and publicly available sources. We use this information to supplement what we collect directly, support marketing activities, and verify accuracy.

We do not knowingly collect personal information from children under 16 through the Website. If you believe a child has provided us with personal information, please contact us so we can delete it.

  • To send marketing emails, newsletters, and event invitations (you can opt out at any time);

  • To prevent fraud, abuse, and unauthorized access, and to enforce our Terms;

We do not sell personal information. We share personal information only as described below:

Service providers. We share information with vendors that perform services on our behalf, such as hosting, analytics, email delivery, customer relationship management, and security. These providers are contractually limited to using the information for the purposes we direct.

Affiliates. We may share information with our corporate affiliates for purposes consistent with this policy.

Legal and safety. We may disclose information when we believe in good faith that disclosure is necessary to comply with law, respond to legal process, protect the rights, property, or safety of Hexmodal, our customers, or others, or investigate suspected fraud or violations of our Terms.

Business transactions. If Hexmodal is involved in a merger, acquisition, financing, reorganization, or sale of assets, information may be transferred as part of that transaction, subject to standard confidentiality protections.

With your direction. We share information with other parties when you direct us to do so.

4. Cookies and analytics

5. Your choices

Marketing email. You can opt out of marketing emails at any time by clicking the “unsubscribe” link in any marketing message or by emailing support@hexmodal.com. We will still send transactional and service-related messages, such as responses to your inquiries.

Cookies. You can manage cookie preferences through the Website’s cookie controls and your browser settings, as described in our Cookies Policy.

Account access. If you contact us, you can ask us to update or correct the information we hold about you.

6. Your California privacy rights (CCPA/CPRA)

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“California Privacy Law”), gives you specific rights regarding your personal information.

Categories of personal information

In the past 12 months, we have collected the following categories of personal information about California residents, as defined under California Privacy Law:

  • Identifiers (such as name, email address, phone number, IP address);
  • Customer records (such as job title, company name, business address);
  • Commercial information (such as products or services you have inquired about);
  • Internet or other electronic network activity information (such as browsing history on the Website and interactions with our emails);
  • Geolocation data (general location derived from IP address);
  • Professional or employment-related information (such as job title and employer);
  • Inferences drawn from the above to create a profile of your interests in our products and services.

We collect this information from the sources described in Section 1 and use it for the purposes described in Section 2. We disclose it for business purposes to the categories of recipients described in Section 3.

Sensitive personal information

We do not collect or process sensitive personal information for purposes that would require providing an opt-out under California Privacy Law.

Sale and sharing

We do not sell personal information, and we do not “share” personal information for cross-context behavioral advertising, as those terms are defined under California Privacy Law. We have not done so in the preceding 12 months. Where applicable, we honor Global Privacy Control (GPC) signals as an opt-out of any such sale or sharing.

Your rights

Subject to verification and certain exceptions, California residents have the right to:

  • Know the categories and specific pieces of personal information we have collected about you, the sources, the purposes for collection, and the categories of third parties with whom we disclose it;
  • Delete personal information we have collected from you;
  • Correct inaccurate personal information we maintain about you;
  • Opt out of the “sale” or “sharing” of personal information (we do not engage in either, but you may submit a request);
  • Limit the use and disclosure of sensitive personal information (not applicable, as described above);
  • Be free from unlawful discrimination for exercising your rights.

How to exercise your rights

To submit a request, email support@hexmodal.com with “California Privacy Request” in the subject line, or call 201-754-8048. We will verify your request by asking you to confirm information we already hold about you. You may designate an authorized agent to act on your behalf; we will require proof of the agent’s authorization and may also require you to verify your identity directly. We will respond within the timeframes required by California Privacy Law.

7. Other state privacy rights

Residents of some other U.S. states may have rights similar to those described above, including the right to access, correct, delete, or obtain a copy of their personal information, and to opt out of certain types of processing. To exercise any such rights, contact us using the information in Section 11. We will respond as required by applicable law.

8. Data retention

We retain personal information for as long as necessary to fulfill the purposes described in this policy, including to provide information you request, maintain business records, comply with legal obligations, resolve disputes, and enforce our agreements. Retention periods vary based on the type of information and the context in which it was collected.

9. Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, and disclosure. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.

10. International users

The Website is operated from the United States and is intended for users located in the United States. If you access the Website from outside the United States, you understand that your information will be transferred to, stored, and processed in the United States, which may have data protection laws different from those of your jurisdiction.

11. Changes to this policy

We may update this Privacy Policy from time to time. The “Last updated” date at the top of the policy indicates when it was most recently revised. Material changes will be communicated through the Website or by other appropriate means.
